The National Development and Reform Commission has published the new "Measures for the Administration of Overseas Investment," which aims to better safeguard the development and security of overseas investments through institutional arrangements. The Measures consist of 76 articles divided into six chapters: General Provisions, Guidance and Services for Overseas Investment, Supervision and Regulation of Overseas Investment, Protection of Overseas Investment, Legal Liability, and Supplementary Provisions. The Measures shall take effect on December 1, 2026, at which time the 2017 "Measures for the Administration of Overseas Investment by Enterprises" will be simultaneously repealed. The State supports investors in conducting overseas investment activities in accordance with market-oriented principles and actively participating in international cooperation and competition. Investors legally enjoy autonomy over overseas investments, exercising independent decision-making, bearing their own risks, and assuming their own profits and losses.
